Despite service of notice, respondents are not represented. Affidavit of service filed in Court is taken on record.

The petitioner obtained a post graduate qualification being M.Sc. approved by the Board under Section 28(2) read with Sub-Section 1(b) of Section 50 of the WBSE Act, 1963. The petitioner after acquiring this qualification, applied for higher scale of pay. The school approved such higher scale of pay for the petitioner and forwarded the same for approval to the D. I. of Schools. The petitioner represented to the D.I. of Schools through his advocate on 28th June, 2019 for sanction of post graduate pay scale but in vain. In that view of the matter, without prejudice to the rights and contentions in law and in accordance thereof, the D. I. of Schools shall dispose of the said representation within a period of three months from the date of communication of a copy of this order.
