Mr. Pinaki Ranjan Mitra ...for the petitioner A direction to secure expeditious disposal of an interlocutory application filed by the petitioner dated 8th March, 2017, praying for examination of hand writing expert in respect of the Will together with some admitted documents for the fair adjudication of the Probate proceeding, is the ultimate relief sought for in this case.

No other point is raised requiring address by this Court.

In view of the nature of order proposed to be made in this case, no prior notice is considered to be necessary.

Service upon the opposite parties stands dispensed with.

As per submission disclosed by the petitioner, the next date before the court below is fixed on 7th February, 2023.

That being the position, the revisional application stands disposed of with a direction upon the learned

Additional District Judge, Second Court, Howrah, in Probate Suit No.20 of 2009 either to dispose of the interlocutory application, referred hereinabove, on the date already scheduled by the court below, providing sufficient opportunity of hearing to either of the parties to this case, but if for any reasons whatsoever, the same could not be possible, the interlocutory application may be peremptorily disposed of within three weeks thereafter.

Petitioner is directed to make communication of this order to the learned court below as well as to the opposite parties and their learned advocate in the court below.
