The grievance of the petitioner is that the petitioner, being a valid tenant in respect of the premises-inquestion, is suffering from absence of electricity, due to the pre-existing meter standing in the name of the landlord having been disconnected at the behest of the landlord, who surrendered such connection.

It is contended that there cannot be any impediment in law to grant such new electricity connection to the petitioner.

It is pointed out by learned counsel for the Distribution Licensee that the petitioner has already approached the concerned Grievance Redressal Officer, South West Regional Office of the CESC Limited on September 7, 2022, with a complaint, a copy of which is annexed at page-10 (annexure-P1) of the writ petition. As such, it is rightly submitted by the CESC Limited that the petitioner ought to exhaust his legal remedy,

which has already been invoked by the petitioner, prior to approaching this court, if at all.

There is substance in such contention.

Hence WPA No. 22539 of 2022 is disposed of by directing the Grievance Redressal Officer, South West Regional Office, CESC Limited to decide the dispute raised by the petitioner as per the complaint as annexed at page-10 of the writ petition, as expeditiously as possible in accordance with law upon giving adequate hearing to all parties concerned.

It is expected that such adjudication shall be concluded by six weeks from date.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
