Petitioner prays for transfer on the ground of distance in between the present school of the petitioner and his place of residence. Transfer application was made on Utsashree portal when portal was alive and thereafter petitioner moved a writ petition being WPA 2235 of 2022 which was disposed of on 11th August, 2022 by a Coordinate Bench directing respondents to process petitioner's application for transfer in accordance with law.

Today, learned advocate representing State respondents has placed a communication dated 11th December, 2024 issued by the District

Inspector of Schools (SE), Jhargram, being respondent no. 3 wherefrom it appears that in terms of order dated 11th August, 2022 passed by the Coordinate Bench transfer application of the petitioner was forwarded to West Bengal Central School Service Commission on 10th September, 2022. Such communication dated 11th December, 2024 is taken on record.

Since transfer application of the petitioner was forwarded to West Bengal Central School Service Commission, Chairman of the Commission is directed to take decision on transfer application of the petitioner in accordance with law by eight weeks from the date of communication of this order, if decision is not taken till date. The decision of the Chairman shall be communicated to the petitioner by two weeks thereafter.

Leave is granted to learned advocate representing the petitioner to amend the causetitle and add Chairman of West Bengal Central School Service Commission as additional respondent in course of this day.

Since Dr. Sutanu Kumar Patra, learned advocate is present in Court who usually represents West Bengal Central School Service

Commission, this Court requests Dr. Patra to enter appearance on behalf of the Chairman of the Commission. Let engagement of Dr. Sutanu Kumar Patra be regularized by the concerned authority of the Commission. Formal service of notice upon the Chairman of the Commission stands dispensed with.

With the above direction, writ petition is disposed of.

There shall be, however, no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
