Allowed that the petitioner is in custody for 141 days and he has been implicated only on the basis of statement of the co-accused. There has been no recovery from the possession of the present petitioner, neither any other means of contact could be established between the petitioner and the principal accused. As such, the petitioner may be released on bail on any stringent conditions. Learned advocate for the State has submitted a report which reflects that petitioner was earlier involved in two criminal cases.

I have taken into account the complicity of the present petitioner and I am of the view that further detention of the petitioner is not warranted as neither any conversation nor any money transaction could be unearthed by the investigating agency.

Having regard to the same, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner namely, Chiranjib Bar @ Chiranjit Bar shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act, Barrackpore. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of 24 Parganas (North) without prior permission of the learned special court.

Accordingly, CRM (NDPS) 1180 of 2025 is allowed. Report submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
