In the matter of : Sk. Miraj Ali. ...petitioner. The present revisional application has been preferred against the order dated 1.08.2012 passed by the learned Judicial Magistrate, Additional Court, Arambagh in connection with Misc. Execution Case No.1 of 2011.
Records reflect that, at the time of admission of the revisional application, by an order dated 31.8.2012 a co-ordinate Bench of this Court was pleased to pass the following direction: "In the meantime, stay of operation of the order dated 1.8.2012 be granted subject to the condition that not only the arrear amount shall be liquidated but also the current amount will be paid month by month as usual. I make it clear that in case of solitary default in payment of the maintenance, the privilege so granted above shall stand automatically withdrawn."
Having regard to the directions so passed by a coordinate Bench of this Court, I am of the view that the purpose for which the execution case was filed should have been served by this time. Accordingly, no interference is called for. Thus, CRR 2971 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
