Learned advocate appearing for the State submits a photostat copy of the report in connection with Behala Police Station Case No.184 dated 12.07.2022. The report reflects that the Investigating Agency has arrived at its conclusion declaring the case to be civil in nature. Let the photostat copy of the report be kept with the record.

In the present revisional application the accused persons challenged the continuance of the FIR and the proceedings of Behala Police Station Case No.184 dated 12.07.2022. In view of the report under Section 173 of the Code of

Criminal Procedure so filed before the learned ACJM, Alipore, the present revisional application has become infructuous. Accordingly, the revisional application being CRR 3712 of 2022 is disposed of as infructuous.

Mr. Ganguly, learned senior advocate appearing for the petitioners submits that the de facto complainant has preferred an application under Section 173(8) of the Code of Criminal Procedure. Learned ACJM, Alipore is directed to consider the application under Section 173(8) of the Code of Criminal Procedure. in accordance with law.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
