The revisional application has been preferred against the judgment and order dated July 25, 2012 passed by the learned Additional Sessions Judge, 6th Court, Paschim Medinipur wherein the learned court was pleased to dismiss the revisional application and affirmed the judgment and order dated 28.09.2010 passed by the learned Judicial Magistrate, Jhargram in M.R. Case No.45 of 2007 under Section 125 of the Code of Criminal Procedure. The order of the learned Magistrate reflects that on an appreciation of the evidence, the learned court arrived at a finding of awarding maintenance, thereby granting Rs.1500/- per month to his wife and Rs.1,000/- per month each to the two minor child, aggregating to a sum of Rs.3500/- per month to be paid by the present petitioner.
Having regard to the reasons so assigned by the learned Judicial Magistrate as also the learned revisional court, I am of the view that no interference is called for.
Accordingly, CRR 2972 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
The opposite party/wife will be at liberty to take out an appropriate application before the learned Magistrate for recovery of the arrears.
