Petitioners claim to be owner of the property which the private respondents are trying to encroach. Petitioners when they resisted such overt acts of the private respondents they were abused, threatened and to that effect information was furnished with the Inspector-inCharge of Habra Police Station, however, no steps have been taken till date.

Learned advocate for the State on the other hand submits that the petitioners have approached the learned Executive Magistrate and subsequently the police authorities have also drawn up proceedings on or about 21.09.2025 under Section 126 of the BNSS, 2023. In view of the police authorities having drawn up proceedings for maintaining peace and tranquility, I direct that the police authorities would continue their surveillance and thereafter ensure that there is no violation of law and order in respect of the land dispute

which is existing between the petitioners and the private respondents.

With the aforesaid observations WPA 22496 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioners.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
