Learned advocate appearing for the petitioner has canvassed that the petitioner and her daughter is suffering because of the act and actions of the private respondents and the police authorities are not responding to the representations made by them. Affidavit of service so filed be kept with the record.

Learned advocate for the state has submitted a report. Let the report be kept with the record. Report reflects that petitioner has approached the Executive Magistrate under Section 126 of the BNSS. Police authorities are acting in consonance with the provisions of law. If there is any violation of law which infringes the right of the petitioner and makes out an offence for infraction of

violation of criminal law, petitioner would be at liberty to approach the jurisdictional criminal court under section 175(3)/ section 223 of the BNSS, 2023. So far as the boundary wall is concerned, if there is a dispute, petitioner would approach the jurisdictional civil court.

With the aforesaid observations WPA 22919 of 2024 is disposed of.
