The revisional application was preferred against the order dated 29th June, 2012 passed by the learned Additional Sessions Judge, 4th Court, Suri, Birbhum in connection with Criminal Motion No.43 of 2011, arising out of Misc. Case No.46 of 2009. The records of the revisional application reflect that the subject-matter of the revisional application relates to interim maintenance. The learned Sessions Court by exercising its revisional jurisdiction was pleased to grant interim maintenance to the tune of Rs.2,000/- per month from the date of filing of the application for interim maintenance till disposal of Misc. Case No.46 of 2009.
Having regard to the reasons so assigned by the learned revisional court, I am of the view that no interference is called for as the award for maintenance was an interim measure during the pendency of the main application under Section 125 of the Code of Criminal Procedure.
Accordingly, CRR 2982 of 2012 is dismissed.
Pending application, if any, is consequently disposed of.
Interim order, if any, is hereby vacated.
