Kausik (Allowed) CRM (M) 1737 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/ Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliyaganj Police Station Case No. 159 of 2025 dated 26.04.2025 under Sections 103(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023. Learned advocate appearing for the petitioner submits that the petitioners are in custody for 200 days and the genesis of the case arose in the locality when a quarrel erupted in between the complainant's husband and the accused persons over the issue of water supply in the cultivation of land. Learned advocate submits that there are no antecedents of the present petitioners and since investigation has already been concluded, further detention of the petitioners are unwarranted.

Learned advocate for the State has produced the case diary and drawn the attention of the Court to the statement of the witnesses under section 164 of the Code of Criminal Procedure.

I have taken into account the statement of the witnesses as also considered the period of detention of the present petitioners.

Having regard to the same, I am of the view that further detention of the petitioners are unwarranted. Accordingly, the prayer for bail of the petitioners are allowed.

Petitioners, namely, Sri Pramatha Das & Smt. Pinki Das shall furnish bond of Rs. 20,000/- (Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand) each. One of whom must be local to the satisfaction of the learned CJM, Raiganj, Uttar Dinajpur.

If on bail the petitioners shall not leave the jurisdiction of Kaliyaganj Police Station without prior permission of the learned CJM, Raiganj or in future, the learned Trial Court. The petitioner shall make himself available on each and every date fixed by the aforesaid Courts concerned.

Accordingly, CRM (M) 1737 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
