1. As a result of the orders passed in the present proceedings, learned counsel for the State has produced copy of the letter dated 16th April, 2024 addressed to him by the Director of Health Services, West Bengal. The same contains the orders issued by the Department of Health and Family Welfare, West Bengal, whereby the petitioner's 529 days has been regularized and the pension papers have been sent to the Office of the Principal Accountant General (PAG), West Bengal.
2. According to him, the State's role insofar as the benefits claimed by the petitioner is concerned is. The same however, is to be processed further by the Principal Accountant General, West Bengal.
3. Since the petitioner has approached this court invoking jurisdiction under Articles 226 and 227
of the Constitution of India immediately after filing the Original Application before the West Bengal Administrative Tribunal (OA No.237 of 2024), we leave it to the petitioner to take appropriate steps for impleading the Principal Account General, West Bengal before the Tribunal for pursuing the matter further.
4. We observe that if the petitioner makes an application in this regard within two weeks, the West Bengal Administrative Tribunal shall proceed in the matter by preponing/fixing the next date of the matter within a period of two weeks thereafter; and proceed to conclude the proceedings without any unnecessary delay or undue adjournments.
5. With the aforesaid liberty, the writ application is disposed of.
