Learned advocate appearing for the petitioner has submitted that the execution case being M. Ex. Case No.154 of 2022 and M. Case No.472 of 2019 be fixed on one and the same date before the learned Judicial Magistrate, 5th Court, Barrackpore. Learned Magistrate will on and from the next date onwards try to merge both the cases on the same date. The learned Magistrate would insist both for recovery of the arrears as well as the evidence of the case in respective cases. With the aforesaid observations, CRR 3529 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
