The petitioner seeks compassionate appointment. 2.

The claim of the petitioner for providing compassionate appointment stood rejected by the District Inspector of Schools (SE), South 24 Parganas on August 16, 2022, stating that at the material point of time, the family income of the petitioner was more than the initial gross salary of a Group D staff of the State Government.

Today, learned counsel for the State has placed the instructions forwarded by the DI of Schools dated December 4, 2025 mentioning that the calculation relying on which the claim of the petitioner stood rejected was erroneous. The DI has opined that the petitioner would be entitled to be considered for compassionate appointment; and that the prayer of the petitioner for grant of compassionate appointment is already under process.

As the DI has brought to the notice of the Court that the prayer of the petitioner is under active consideration, accordingly, the instant writ petition stands disposed of by directing the concerned DI of Schools to proceed with the petitioner's application seeking compassionate appointment and reach the same to its logical conclusion in accordance with law at the earliest, but positively within a period of twelve weeks from the date of communication of this order. 5.

If the petitioner is found eligible for compassionate appointment, then necessary consequential steps shall be taken without any further delay.

The impugned order of rejection by the DI of Schools (SE), South 24 Parganas dated August 16, 2022 stands set aside.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.
