And In re: Bikki @ Golam Mostafa ... petitioner Mr. Santanu Talukdar Mr. Priyankar Ganguly Ms. Shalini Bairagi ...for the petitioner Ms. Faria Hossain Ms. Puspita Saha ...for the State Learned Counsel appearing on behalf of the petitioner submits that 1 kg. 464 gms. of brown sugar was recovered from one Anil Chowdhury and the name of the present petitioner transpired from the statement of Anil Chowdhury but nothing was recovered from his possession and he is in custody since 24.6.2025. He further submits that the petitioner has no criminal antecedent and as such he may be released on bail on any terms and conditions. Learned Counsel appearing on behalf of the State vehemently opposed the bail prayer contending that investigation reveals huge amount of money trail in the account of the present petitioner by the said Anil Chowdhury from whom huge quantity of narcotic substance was recovered. She further submits that the investigation is still continuing.

Having heard learned Counsel for the petitioner and the State and the materials placed before me during the course of hearing, prima facie shows the petitioner's involvement with the alleged offence and therefore rigour of Section 37 of the NDPS Act clearly attracts in

respect of the present petitioner, therefore the prayer for bail is considered and rejected.

The application, being CRM (NDPS) 1173 of 2025 is accordingly disposed of.
