1. I have considered the materials on record. Opposite party no. 2 instituted proceeding under Section 12 of Protection of Women from Domestic Violence Act and order of monetary relief at the rate of Rs.6,000/- per month to the opposite party no. 2 and Rs.4,000/- per month for the child had been passed. Execution proceedings were instituted for non-payment of monetary relief.

2. Petitioner has assailed the said proceeding claiming he was not aware of institution of maintenance proceeding.

The maintenance order has become final. Nothing is placed on record that the maintenance allowance has been liquidated. There is no illegality in institution and continuation of the execution proceeding.

3. Accordingly, application being CRR 3923 of 2024 is dismissed. (Joymalya Bagchi, J.)
