The petitioner complains of alleged over-action on the part of the Kalighat Police Station.

It appears that the petitioner is the owner of a property and has filed a complaint with the police against third parties claiming rights in respect of the property on 23rd March, 2019. Kalighat Police did not take any steps on the complaint.

The private respondents/promoters have, however, lodged complaint against the petitioner in September, 2022. The police have called the petitioner several times in connection with the complaint of the private respondents for collection of documents. 4.

This Court is of the view that the dispute amongst the petitioner, the private respondents and the third party is purely civil in nature. The police have nothing to do in

the matter. The parties may approach appropriate civil forum in this regard.

Kalighat Police shall not summon the petitioner any further as of now. However, if the private respondents is of the view that there is criminality in the actions of the petitioner, appropriate steps may be taken under section 156(3) of the CrPC.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
