The petitioner complains that the private respondent has dispossessed him after possession was granted of the property in question by a Civil Court in Ejectment Execution Case No. 12 of 2020 passed by the learned Civil Judge (Jr. Division), 2nd Court at Alipore.

The petitioner has complained to the police of alleged inaction on the part of the Karaya Police Station.

The Karaya Police Station has registered FIR on the petitioner's complaint and has completed investigation and has filed charge sheet being Karaya P.S. Charge Sheet No. 202 of 2022 dated 16.02.2023 against the private respondent.

This Court finds no inaction on the part of the police.

The petitioner may seek, inter alia, execution afresh of the decree obtained by him to file a fresh civil proceeding.

With the aforesaid observation, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

8.

The report of the Karaya Police Station dated 27.04.2023 is kept with the record.

9.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
