Siddiqui Mr. Nilotpal Chatterjee ... ... for the State In this public interest petition the allegation is that the plantation was done in the open space in front of the Khodambari-I Gram Panchayat and that the private respondent has destroyed the plantation and has extended his business by encroaching upon the government land for his personal gain and thereafter has also constructed a building by occupying a portion of the government property which he is using for his business purpose.

The record reflects that the representation dated 2nd September, 2022 in this regard in the form of legal notice has already been sent to the respondent no.4, District Magistrate, Purba Medinipur.

Learned counsel for the State has fairly stated that the representation so sent can be decided by the respondent no.4.

Hence, we dispose of the present petition by directing the respondent no.4 to duly consider the grievance raised in the representation dated 2nd September, 2022 and take an appropriate action in

accordance with law after giving opportunity of hearing to all the concerned parties.

Let this exercise be completed within a period of three months from the date of receipt of a copy of this order.
