Affidavit of service filed in Court today be kept with the records.

The petitioner participated for recruitment in Constable (GD) in CAPFs. He failed to qualify in the physical standard test. He was found deficient in height. He preferred an appeal before the appellate authority on the same day but there has been no change in his height.

The petitioner submits that in the earlier examination in which he participated, he was found qualified in the physical standard test and he was found to have the requisite height.

Prayer has been made to direct the authority to consider the measurement of his height taken in the earlier selection test.

The aforesaid submission of the petitioner is opposed by the learned advocate representing the respondents.

The respondents rely on the judgment delivered by the Hon'ble Division Bench of this Court on September 11, 2025 in FMA 964 of 2025 [Harun Miah vs. Union of India & Ors.] wherein the Court specifically held that what is important and relevant is the measurement taken at the time of the subject recruitment process and not the earlier recruitment process.

In view of the law laid down by the Hon'ble Division Bench of this Court, no relief can be granted to the petitioner in the instant case.

The writ petition fails and is hereby dismissed. 9.
