The petitioner complains of alleged inaction on the part of the Regent Park Police Station. The petitioner complains that the genesis of the dispute is a plot of land occupied by a club, whose members keep changing from time to time. The petitioner has obtained a decree in civil suit being T.S. No.417 of 2010 from the 1st Civil Judge (Junior Division) at Alipore.

Learned counsel for the police submits that the private respondents have filed Title Suit No.511 of 2019 before the 2nd Additional Civil Judge (Junior Division) at Alipore and the Title Suit No.89 of 2020 before the 2nd Additional Civil Judge (Junior Division) at Alipore. 3.

On the petitioner's complaint earlier in 2016 and 2018 Regent Park Police Station has registered FIRs and charge sheets being Regent Park Police Station Charge Sheet Nos.112/2016 and 29/2019 have been filed.

On the basis of the further complaint of the petitioner in August 2022, FIR being Regent Park Police Station Case No.266 dated 11th October, 2022 has been registered. Investigation is on.

It is ordered that the investigation into the subject FIR be completed as expeditiously as possible preferably within a period of one month from date. 6.

The petitioner may pursue civil remedies in respect of his property.

Regent Park Police shall, however, ensure that there is absolutely no breach of peace in the area. 8.

With the aforesaid directions, the writ petition shall stand disposed of.

There shall be no order as to costs.

Report of the Officer-in-Charge, Regent Park Police Station, Kolkata Police is taken on record. 11.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
