Present petition has been filed challenging the order dated 27th August, 2025 passed by learned Sessions Judge, Alipore, South 24-Parganas in Criminal Revision No. 53 of 2025. Petitioner submits that complaint cases under Section 138 of the Negotiable Instruments Act was filed by the petitioner herein bearing complaint Case No. 1674 of 2018. While the matter at the stage of cross-examination of the petitioner/complainant the opposite party/accused moved an application for sending exhibit No. 3 and 4 i.e. two letters by the complainant/petitioner to the opposite party/accused for QDEV (CID West Bengal) and further prayed that till the expert opinion is received the cross-examination is deferred.

Learned trial court did not agree with the opposite party and it was inter alia of the view that the report
of the QDEV (CID West Bengal) shall be considered at the time execution and passing order.

Learned Sessions judge in the revision petition inter alia passed an interim order staying the order of the learned court.

Petitioner/complainant aggrieved of this has invoked the jurisdiction of this court .

The Court considers that at the outset the present petitioner is liable to be relegated back to the learned Sessions Judge. Learned Sessions Judge has only passed the interim order and matter is still pending for consideration before the revisional court.

In this circumstances, the present petition is disposed of with a direction to the learned Sessions Judge to dispose of the revision petition on the next date of hearing which is stated to be 15th December, 2025 in accordance with law.

Let copy of this order be sent to the learned Sessions Judge.
