Mr. Bidyut Kumar Halder Mr. Indranil Halder ... for the petitioner Mr. Debanjan Mukherjee ...for CESC Limited On an earlier occasion, the petitioner had approached this Court by filing WPA 24630 of 2024, apprehending disconnection of electricity supply by Calcutta Electric Supply Corporation (CESC) due to non-payment of dues.

By an order passed in the said writ petition, a Coordinate Bench of this Court directed the petitioner to pay a sum of ₹7,00,000/- (Rupees seven lakh only) within November 20, 2024, and the balance dues in four equal monthly instalments.

The learned advocate appearing for CESC does not dispute that the petitioner has paid the said amount. However, he submits that the instalments were paid after considerable delay.

The petitioner has now once again approached this Court due to a threat of disconnection on the ground of non-payment of current electricity dues. The learned advocate for CESC submits that the petitioner has again defaulted in making timely

payment of electricity charges, and as of date, a sum of ₹7,46,640/- (Rupees seven lakh forty-six thousand six hundred and forty only) is payable. It is further alleged that the petitioner has developed a pattern of not paying dues on time and seeks orders from this Court merely to regularise delayed payments.

This Court, in the interest of justice, is inclined to grant one further opportunity to the petitioner, subject to strict compliance with the following directions:

The petitioner shall pay a sum of ₹5,00,000/- (Rupees five lakh only) on or before October 5, 2025. The balance sum of ₹2,46,640/- (Rupees two lakh forty-six thousand six hundred and forty only) shall be paid in five equal monthly instalments. The first instalment shall be paid within the first week of November 2025, and the remaining instalments shall be paid within the first week of each succeeding month.

It is made clear that the petitioner must continue to pay his current electricity bills regularly and without default.

It is further clarified that in the event of any failure on the part of the petitioner to comply with the terms of this order, CESC shall be at liberty to disconnect the electricity connection without any further reference to this Court.

In such an event, the Officer-in-Charge of Golabari Police Station shall extend necessary assistance to CESC, without insisting on any cost. Accordingly, WPA 22353 of 2025 is disposed of.
