Roy Mr. Ankit Sureka Mr. Biplob Das Mr. Asis Dutta ...for the respondent Nos. 2,3 & 4 Mr. Atindranath Misra ...for the respondent No. 6 The petitioner has approached this Court seeking issuance of a writ of mandamus restraining the Bank from taking any coercive steps in respect of the default loan account standing in the name of Arya Engineering Works.

It appears from the submissions made on behalf of both the parties that a considerable sum is due and payable on account of the loan. The petitioner intends to obtain benefit under the One Time Settlement scheme of the Bank.

Learned advocate representing the Bank submits, upon instruction that, as on date, more than Rs.17,00,000/- is due and payable by the loanee.

It appears that, at present, there is no scheme under which the default loan may be settled under the One Time Settlement scheme.

The petitioner is aggrieved by the amount of penal interest that has been charged.

The petitioner will be at liberty to approach the Bank for remission of penal interest.

If any application is filed by the petitioner, the Bank shall take the same into consideration in accordance with the relevant guidelines.

The writ petition stands disposed of.
