None appears for the private respondents despite service.

The petitioner alleges that the private respondents are disturbing his peaceful possession in respect of his property and are trying to oust him therefrom by resorting to illegal means.

The petitioner lodged complaint before the police station in this regard, but to no effect.

It appears from the report and is also submitted on behalf of the State that a specific case being Canning PS Case No.647 of 2025 dated 22nd September, 2025 has been registered on the basis of the complaint lodged by the petitioner and investigation is in progress. The report

indicates a long standing land dispute between the petitioner and the private respondents. It also appears that the police is closely monitoring the situation and the local police camp is instructed to keep a close watch to prevent any untoward incident.

In view of the fact that a specific case has been registered on the complaint lodged by the petitioner and also that the police is keeping strict vigil on the law and order situation of the area, this Court is inclined to hold that the civil dispute between the parties needs to be addressed before the appropriate forum. However, the relevant PS is directed to continue to monitor the situation so that no untoward incident takes place.

With the above observations and directions, the writ petition is disposed of.

However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
