Learned advocate appearing for the petitioner submits that the petitioner is in custody for two years and till date charges have not been framed. Prosecution has relied upon 18 witnesses in order to prove its case. As there is no scope of the trial commencing or concluding very seen, the petitioner be released on bail.
Learned advocate for the State opposes the prayer for bail and submits that the fatal blow was inflicted by the present petitioner. All efforts would be taken by the prosecution for progress of the case.
Having considered the manner in which the case is progressing, I direct the learned trial Court to take steps for
consideration of charges, if the charges have not been till date considered and framed. Efforts be taken to conclude the examination and cross-examination of 8 witnesses by 31st of May, 2026.
No unnecessary adjournment be granted to any of the parties and the trial of the case would continue in spite of the resolution of the local bar.
State is directed to communicate this order to the learned trial Court.
Petitioner would be at liberty to renew his prayer for bail after the aforesaid time period is over.
Accordingly, CRM (M) 1740 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
