The petitioner has filed the present application being CAN 1 of 2025 praying for recalling of the order dated November 7 2025 wherein this Court has dismissed the writ petition for default for non-appearance of the writ petitioner when the matter was called.

2. Learned counsel for the petitioner submits that due illness of the learned advocate-on-record, the learned advocate-on-record did not appear before this Court and this Court has dismissed the writ application.

3. Heard the learned counsel for the parties.

4. This Court finds that the petitioner has shown sufficient cause for non-appearance of the petitioner before this Court when the matter is called. Accordingly, the order dated November 7, 2025 is recalled.

5. WPA 22663 of 2025 is restored in its original file.

6. CAN 1 of 2025 is disposed of.

7. This Court finds that the grievance of the petitioner in the writ application for grant of new electric connection. The petitioner has requested to the CESC for grant of electric connection and also paid the applicable charges but the CESC has not provided new electric connection to the petitioner.

Learned counsel for the CESC submits that the officials of CESC has been visited to the premises of the petitioner for providing new electric connection but there was an objection of the inmates of the property-in-question. Accordingly, CESC has not in a position to provide new electric connection to the petitioner. He further submits that the petitioner was not informed whether the petitioner was installed the main switch so that CESC can provide new meter.

9. Considering the submission made by the learned counsel for the parties. The CESC is ready and willing to provide new electric connection but there was an obstruction from the inmates of the property-in-question.

In view of the above, the writ petition is disposed of by directing the petitioner to inform whether he installed the main switch to the respondent no. 2, District Engineer, CESC Limited and after getting the information from the petitioner, the CESC shall provide new electric connection/meter to petitioner from the existing meter position within a period of one week from the date of receipt of the information and compliance of all formalities by the petitioner.

It is made clear that if there is any obstruction from any persons for installation of the new meter in the premises of the petitioner, the concerned police authorities that is the Officer-in-Charge, Beniapukur Police Station shall provide appropriate police assistance to the officials of CESC for providing new electric connection in the premises of the petitioner at the existing meter board connection and, if any, cost is to be paid for the police protection, the petitioner shall bear the cost of the police protection.

It is further made clear that if any pad lock is require to be open and the person who is the authority of the said pad lock is not allowing the CESC officials or the petitioner to open the pad lock, the petitioner shall open the pad lock in presence of police personnel only for the purpose of getting the electric connection and after getting the electric connection the petition will put the new pad lock in the said meter board and will hand over the key to the concerned person in presence of the police personnel.

13. WPA 22663 of 2025 is disposed of.

14. Urgent Xerox certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
