Report in the form of affidavit filed on behalf of the State respondent is taken on record.

The instant writ petition is preferred for re-enquiry in respect of petitioner's application against the new FPS vacancy notification no.692/RFS/2023 dated September 1 of 2023. It is the case of the petitioner that concerned "SCFS" during the enquiry of the proposed godown of the petitioner has instructed the petitioner to signature over some blank paper. Petitioner also alleged that godown of the present petitioner as well as the other applicants were enquired on May 28, 2024 and May 29, 2024 rather the godown of the private respondent was enquired in the month of June 2024. It appears that the present petitioner has submitted a representation with the Secretary, Food Supply Department, Government of

West Bengal. The concerned Secretary has not taken steps in respect of that representation. Report of the State discloses that the enquiry was conducted over the proposed shop cum godown of the applicants.

After considering the submissions of the parties I kept the matter open for the concerned Secretary i.e. respondent no.2 to decided issue i.e. representation of the petition.

Under the above observation, the writ petition is disposed of. The respondent no.2 is directed to consider the representation of the petitioner being annexure P-8 of this writ petition and shall pass a reasoned order after hearing the parties within eight weeks from the date of passing of this order. The decision shall be intimated to the petitioner within two weeks thereafter.

I make it clear that this court has not entered into the merits of the allegation of the present petitioner. The respondent no.2 shall pass a reasoned decision without being influenced by any order of this Court and without being influenced by any laater decision of the State Authority for new appointment of in respect of the same location.
