Learned advocate appearing for the petitioner is directed to serve a copy of this revisional application upon Ms. Manisha Sharma, learned advocate, who ordinarily appears for the State. Her appointment may be regularised by the concerned authorities.
The petitioner has challenged the proceedings of Nagerbazar Police Station Case No. 136 of 2023 dated 23.04.2023 under Sections 341/323/506 of the Indian Penal Code wherein under the same sections charge-sheet has been submitted before the jurisdictional court.
The factum of the case is that the complainant/opposite party no.2 is the Sub-Postmaster who was assaulted inside his office by the present petitioner, subsequent to which the FIR was registered.
The learned advocate appearing for the petitioner submits that the present petitioner is also a Branch Manager who has also instituted a case being Nagerbazar Police Station Case No. 127 of 2023 dated 19.04.2023. If there are incidents, both the cases would continue. If required, the learned CJM/ACJM-in-charge would take
decision whether both the cases would be tried by one and the same court and one after the other provided the same are case and counter-case. No interference is made regarding the merits of the case.
With the aforesaid observations, the revisional application being CRR 3542 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
