Report submitted by Mr. Arijit Ganguly, learned advocate appearing for the State be kept with the record. Earlier by an order dated 23 November, 2022, a report was called for from the Officer-in-Charge/Insepctor-in-Charge of Khardah Police Station to record a fresh statement of the de facto complainant, at whose instance, Khardah Police Station Case No. 717 of 2013 dated 04.09.2013 was registered under Sections 498A/406/34 of the Indian Penal Code .
The report reflects that a fresh statement of the lady being opposite party no. 2 has been recorded. The statement reflects that parties have decided to re-unite and stay together. In view of the change of circumstances as is reflected from the
communication made to the Officer-in-Charge, Khardah Police Station, I am of the opinion that further continuance of the Khardah P. S. Case No. 717 of 2013 dated 04.09.2013 pending before the learned Judicial Magistrate, 1st Court, Barrackpore, North 24 Parganas is unwarranted and as such is hereby quashed. Accordingly, the present revisional application being CRR 3728 of 2021 along with CRAN 1 of 2022 is allowed. Pending applications, if any, are consequently disposed of.
