The petitioner has prayed for expeditious disposal of Case No. 85 of 2019 under Sections 323/448/504/506 of the Indian Penal Code pending before learned Judicial Magistrate, 2nd Court, Serampore.

Learned advocate appearing for the petitioner submits that hardly there is any progress in the trial of the case, although the examination under Section 251 of the Code of Criminal Procedure is over. Attention of the Court has been drawn to the list of witnesses which are four for the present, when the complaint was filed before the jurisdictional court. Having regard to the fact that almost four years have passed since the initiation of the instant case, I direct the learned trial court to fix at least one date in every three months so that trial of the case can be taken to its logical conclusion within a reasonable period of time.

No unnecessary adjournment should be granted to either of the parties and in case, on three occasions a witness is not present, the learned trial court would consider the evidence of the witness to be closed.

With the aforesaid observations, the revisional application being CRR 3545 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
