Report submitted by the State is taken on record. Learned counsel for the petitioner submits that the property in question was purchased by the petitioner and his brother jointly and the petitioner has been running business therein. The petitioner's brother sold out the property to the private respondents who has been disturbing the peaceful possession of the petitioner in the property and creating obstruction in his business. The petitioner lodged a complaint before the police authority but to no effect.
Learned counsel for the State submits that the dispute between the parties is civil in nature and pursuant to the complaint of the petitioner, prosecution has been submitted under Section 126 of the BNSS. M.P. case filed under Section 163 of the BNSS is also pending before the learned Sub-Divisional Executive Magistrate, Arambagh, Hooghly.
Learned counsel for the private respondents echoes the submission made by the State and submits that after purchase of the property by the private respondent who also run business therein, there has been kind of misunderstanding between the parties which has led to the complaint of the petitioner.
The dispute between the parties appears to be civil in nature. The petitioner is at liberty to approach the appropriate forum for redressal of his grievance. In the meantime, police authority is directed to keep strict vigil over the area so that no untoward incident takes place and to ensure maintenance of peace and tranquility therein. With the aforesaid observation and directions, the writ petition is disposed of.
There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
