Heard learned advocates appearing for the parties. Petitioner has filed this writ petition being aggrieved by inaction on the part of the respondent Secretary of the co-operative societies in question in considering her application for membership of the society in question after the death of her husband. It appears from record that on 10th July, 2022, petitioner has made a representation to the respondent Secretary. It is further grievance of the petitioner that till date no decision has been taken and nothing has been heard by the petitioner from the end of the Secretary. Learned advocate for the petitioner also files a supplementary affidavit enclosing a document issued on 13th October, 2022 by the Joint Secretary of Co-operative Society, on perusal of which it appears that the Secretary

of the Co-operative Societies has been asked to regularize the membership of the petitioner and it is the allegation of the petitioner that in spite of such specific direction, the Secretary has not taken any action till date. Considering the submission of the parties and facts and circumstances of this case as appears from record, this writ petition being WPA 22645 of 2022 is disposed of by directing the respondent Secretary of the Co-operative Society in question to take a decision on the application of the petitioner made before him on 10th July, 2022 in accordance with law and particularly by taking into consideration the direction of the Joint Registrar of the Cooperative Society by its letter dated 13th October, 2022, within three weeks from the date of communication of this order. Needless to mention that before taking such decision by the Secretary on the application of the petitioner, petitioner or her authorized representatives shall be given opportunity personal hearing.
