Petitioner complains that in spite of the dues having been cleared the private respondents are threatening and abusing the petitioner and her family members.

State has submitted a report. Report reflects that proceedings have been drawn up under section 126 of the BNSS as also it is reflected that the writ petitioner preferred an application under section 163(2) of the BNSS.

In view of the steps taken by the police authorities, I am of the opinion that steps were taken adhering to the provisions of law. In case, petitioner is of the opinion that cognizable offence is made out, petitioner would be at liberty to take out an appropriate application under section 175(3) of the BNSS before the jurisdictional Magistrate.

Learned Magistrate will assess and ascertain regarding the genuinity of the allegations and thereafter pass necessary directions as he deems fit and proper.

With the aforesaid observations WPA 22589 of 2025 is disposed of.

Report submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.
