The State of West Bengal & Ors.

Mr. Sharanya Chatterjee, Mr. A. Ghosh, ...for the Appellant.

1. The learned Counsel for the appellant submits that he has no instruction to proceed with the appeal.

2. It appears that the writ petition filed for compassionate appointment was rejected on the ground that the petitioner could not fulfil the income criteria. The financial hardship was not proved.

3. We do not find any reason to arrive at a contrary finding.

4. Under such circumstances, the appeal stands dismissed.

5. However, there shall be no order as to costs.
