Learned counsel for the State submits that the petitioner's father's name as recorded in the affidavit appended to the writ petition and the caste certificate issued in his favour by the Circle Officer, Giridih, Jharkhand is different. Despite notice upon the petitioner to clarify the same, he did not turn up at the police station.

Learned counsel for the petitioner submits that besides the documents already filed by the petitioner, he has no other document in respect of the query made by the Investigating Officer.

Learned counsel for the private respondents submits that the petitioner was not present at the place of occurrence at the time of alleged incident.

Learned counsel for the petitioner denies and disputes the said contention.

The petitioner is directed to cooperate in investigation of the case. The Investigating authority is directed to take the investigation to its logical conclusion in view of the time frame laid down for the purpose in Rule 7(2) of the Schedule Casts and Schedule Tribes (Prevention and Atrocities) Rules, 1995.

Keeping the writ petition pending shall not serve any fruitful purpose.

The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
