....Applicant/Petitioner Mr.Rana Mukherjee Mr. Soujanya Pattanayak ...for the petitioner Ms. Sayanti Santra Mr. Mainak Gupta ..for the State Report filed on behalf of the State is taken on record. No one appears on behalf of the alleged victim despite service. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been falsely implicated in this case. It is learnt that the victim did not proceed with the matter. Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. She relies on the statements of the two minor girls/alleged survivors as also on the statements of the brother of the victim and the local witnesses. The prosecution case is that the petitioner used to tease and abuse the victims and used to make vulgar gesture. When the brother protested, he was thrashed up. As the locals came to rescue them, the accused fled away.

Considering the incriminating materials available in the case diary and the alleged role ascribed to the present petitioner, I do not consider this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail of the petitioner is rejected.
