As none appears on behalf of the State, Ms.

Kakali Naskar, learned advocate, who ordinarily appears for the State, is directed to represent the State. Her appointment may be regularised by the concerned authorities.

Petitioners complain that petitioners are the absolute owner in respect of property which is used for car parking. To that, private respondents are trying to encroach and grab the property.

On the other hand, private respondents also claim to have ownership over the said property. Records also reflect that information has been repeatedly sent to the police station and a title appeal is pending.

In view of the claim and counter-claim before this Court, I direct that police authorities would ensure that there is no breach of the peace and violation of law and order in respect of the parking

space which is the subject-matter of the present writ petition.

With the aforesaid observations, the writ petition being WPA 22783 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
