The petitioners complain of illegal and unauthorized construction.

On a perusal of the averments made in the writ petition, the prayers made therein and the documents annexed to the writ petition it appears that there is not a single averment alleging unauthorized construction. Learned advocate appearing for the State respondents submits that the writ petition is liable to be dismissed.

After the matter is heard for quite some time, the learned advocate appearing for the petitioners seeks leave to withdraw the writ petition and file fresh writ petition.

Leave sought for by the learned advocate for the petitioners is allowed.

The writ petition is permitted to be withdrawn. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
