Petitioners approached this Court being aggrieved 13.08.2025 Court No. 35 M/L. No.869 Rakib by the inaction of the police authorities and prayed that the physical possession in respect of a plot of land be ensured by the police authorities.
Having considered the prayers so advanced, I am of the view that the police authorities are hardly empowered to ensure any individual, so far as the property is concerned.
At the relevant point of time State drew up a proceeding under Section 107/116 of the Cr.P.C. Police authorities have also registered a case being Pandua Police Station case no. 364/2024.
Learned advocate appearing for the respondent nos. 5, 6, 7 and 10 denies and dispute the contention and further submits that the writ petition is not maintainable having background of a civil dispute relating to a land. Having considered the nature of the dispute, I am of the view that police authorities had taken appropriate steps at the relevant point of time. Police authorities
would keep a vigil and ensure that there should not be any violation of law and order.
With the aforesaid observations WPA 23043 of 2024 is disposed of.
