The order under challenge was passed in the year 2004 in respect of N.G.R.(E) No.444 of 2004 under Sections 107/116(3) of the Code of Criminal Procedure, pursuant to the G.D. Entry No.237 dated 16.08.2004 at Kanaipore Beat House. Having regard to the period of time, which has elapsed in the meantime i.e. more than 17 years, I am of the opinion that the proceeding before the Learned Executive Magistrate has become infructuous.
If the proceedings are still progressing and pending before the Learned Executive Magistrate, Serampore, Hooghly the same is deemed to be quashed.
Thus, CRR 3112 of 2004 is allowed.
All pending connected applications, if any, are consequently disposed of.
The proof of service submitted by learned advocate for the petitioner, be kept with the record.
