The State of West Bengal Mr. Abhishek Chakraborty, Mr. Musharraf Alam ... for the petitioner This is an application wherein petitioner has prayed for expeditious disposal of Malda Police Station Case No.118 of 2019 dated 03.03.2019 corresponding to GR Case No.820 of 2019 presently pending before learned Chief Judicial Magistrate, Malda Learned Counsel for the petitioner submits that the case was initiated on 03.03.2019 and the charge-sheet submitted against the accused persons on 31st May, 2019 and since then the matter is pending in the Court of learned Chief Judicial Magistrate and the case has not been committed to the Court of Sessions as yet and as such he prayed for a direction upon the Court below for expeditious disposal of the instant proceeding. Having heard learned Counsel for the petitioner, I find that the prayer made by the petitioner is innocuous and if any order is passed in terms of the prayer made in the petition, the opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with.

Having heard learned Counsel appearing on behalf of the petitioner and that the prayer made by the petitioner is justified in terms of long pendency of the proceeding before the Court below, the prayer made by the petitioner is allowed. Learned Trial Court is hereby directed to commit the case if he finds that the offence alleged against the petitioner is triable by a Court of Sessions within a period of 60 days after serving copy to the accused persons. However, if he finds that the offence is not triable by a Court of Sessions, he will conduct the trial and make every endeavour to conclude the trial preferably within a period of 6 months from the next date of hearing.

The order is passed invoking this Court's jurisdiction under Section 529 of the BNSS.

CRR 4269 of 2025 thus stands disposed of.
