1. Submission advanced on behalf of the petitioner that the petitioner is in custody for more than 76 days and chare-sheet has been submitted. More so, it is the case of circumtancial evidence and direct involvement of the petitioner is found.

2. Learned prosecution raised objection and draws attention of this case to the statement made by the witness under Section

164. Charge-sheet has been submitted of this case and charge has not yet been framed. Therefore, the considering the facts and circumstances of this case, this court is not inclined to passed any favourable order at this stage to the petitioner.

3. Accordingly, the prayer stands rejected.
