This is an application for expeditious hearing of the Misc. Case No.17 of 2020 arising out of Title Execution Case No.7 of 2019.

It appears from the record that 19th August, 2023 was fixed for hearing of the said Misc. Case under Order XXI Rule 97 of the Code of Civil Procedure.

The learned advocate for the petitioner submits that on 19th August, 2023 the Misc. Case was not heard and it was adjourned to 7th October, 2023.

CO 3258 of 2023 is disposed of by requesting the learned Civil Judge (Senior Division), 2nd Court at Barasat to dispose of all the applications/ Misc. Case in connection with Title Execution Case No.7 of 2019 as well as the said Title Execution Case as expeditiously as possible without granting any unnecessary adjournments to either of the parties. The petitioner shall be obliged to forward a copy of this application upon the opposite parties

and/or their learned advocates appearing in the executing court along with a copy of this order. There will be no order as to costs.

Urgent certified copy of this order, if applied for, be given to the learned advocates for the parties on usual formalities.
