Shanti Halder And ANR v. The State Of West Bengal
11.11.2025 Sl. No.71 NB CRM (A) 3379 of 2025 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Bhimpur P.S. Case No.53/2023 dated 22.02.2023 under Sections 379/411/413/414/120B/34) of the Indian Penal Code corresponding to Section 304/317(2)/317(4)/317(5) of BNS, 2023. And In the matter of: Shanti Halder & Anr.
... petitioners Mr. Manabendra Thakur.
...for the petitioners.
Ms. Shreyashee Biswas, Ms. Nandini Chatterjee.
...for the State.
Mr. Kunal Ganguly ...for the de facto complainant.
Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioners submits that this is a second application for anticipatory bail filed due to material change in circumstance. A charge sheet has now been filed.
Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail and submits that proclamation has been issued against the present petitioners.
It further appears that after submission of charge sheet, an additional charge was brought in.
Considering the materials available in the case diary, the fact that there is no material or substantial change in circumstance to entertain a second application for anticipatory bail and the fact that proclamation has already been issued against the petitioner, I do not consider this to be a fit case for granting anticipatory bail to the present petitioner.
The application for anticipatory bail being CRM (A) 3379 of 2025 is, thus, rejected.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
