For the Petitioner The petitioner has preferred this revisional application challenging the order dated 24.8.2022 passed by the Learned Judicial Magistrate, 3rd Court, Barrackpore in M. Case No. 682 of 2020.

The order reflects that a sum of Rs.1,500/- per month was awarded as an interim maintenance.

The order also reflects that the husband/o.p. is earning at least a sum of Rs.12,000/- per month. That being the findings of the Learned Magistrate. At least, the Learned Magistrate should have awarded 1/3rd or 1/4th of the said amount concerned.

In view of the aforesaid observations, I direct that the petitioner would bring this order to the notice of the Learned Magistrate and the Learned Magistrate will reconsider the amount after hearing the O.P. and the same may be considered within a period of three weeks from the date of communication of this order.

With the aforesaid observation CRR 3738 of 2022 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order, duly collected from the official website of the Hon'ble High Court, Calcutta.
