Petitioners complain that in spite of representation filed with the police authorities no steps have been taken in respect of complaint dated 15.07.2024 and 13.09.2025.

I find from the police report that Bhadreswar Police Station case no. 304/24 dated 15.07.2024 was registered for investigation under Sections 85/115(2)/3(5) of the BNS and charge-sheet has also been subsequently submitted. Petitioners have also informed the police station on 13.09.2025, so far as the information furnished on 13.09.2025 Bhadreswar PS G.D. Entry no.1275 dated 24.09.2025 has been registered. A family feud arising out of matrimonial dispute which is continuing, to that effect series of cases have been filed. It also reflect from the police report a case under the provisions of PWDV Act has been preferred being MC No. 187 of 2024 pending before the A.C.J.M. Chandannagar, Hooghly, another Title Suit being T.S. 406 of 2024 is

pending before the learned Civil Judge (Junior Division), Chandannagar. At the behest of the respondent no.6 a case has been registered as Bhadreswar PS NCR No. 927 01.08.2024. Presently series of cases are inter se pending between the petitioners and the private respondents. Petitioners now intend to enter matrimonial home. Since a case is pending before the learned A.C.J.M. under the relevant provisions of PWDV Act, if any directions is passed for residential rights and directions are also passed upon the police authorities, police authorities would ensure that the order of the learned Judicial Magistrate is respected.

With the aforesaid observations WPA 22771 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioners.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
