Mr. Bhattacharya, learned advocate appearing for the petitioner submits that in spite of persuasion and repeated attempts to establish contact with the petitioner, there has been no response from the petitioner.

Learned advocate for the petitioner submits that as there are no instruction further to appear for the petitioner, he intends to recuse himself from the revisional application. Mr. Lahiri, learned advocate appears on behalf of the complainant/opposite party no.2. Learned advocate files an affidavit reflecting that intimation was sent upon the petitioner regarding the date fixed for hearing. Let the affidavit of service be kept with the record.

In view of the submissions so advanced before this Court by either of the parties, it seems that the petitioner is not interested in pursuing the revisional application.

Accordingly, CRR 3053 of 2017 is dismissed for default.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.

The learned Trial Court is directed to proceed with complaint case no. C-0062851 of 2016.
