1. Petitioner contends he was a member of a political party. Subsequently, he changed his political affiliation. In retaliation, a series of criminal cases have been registered including the present one. It is contended he was illegally arrested from Hyderabad without following statutory formalities. Accordingly, he prays for quashing of the impugned proceeding being G.R. Case No. 455 OF 2018 arising out of South Bidhannagar Police Station Case No. 93 of 2018 dated 28.06.2021 pending before the learned Additional Chief Judicial Magistrate at Bidhannagar, North 24 Parganas.

2. I have considered the materials on record including the allegations in the charge-sheet. It is alleged opposite party no. 2 is engaged in supply of raw materials to various companies. In the month of March, 2018 an unknown person approached him and asked him to meet the petitioner at the side of City Centre II. He was threatened if he did not meet the petitioner he would face dire consequences. When he met the petitioner the latter demanded a sum of Rs.3 lakhs. On 07.03.2018 at 8 PM opposite

party no. 2 handed over Rs. 2 lakhs under threat and coercion to the petitioner. It is contended the allegations are false and the FIR was belatedly registered. Uncontroverted allegations in the impugned charge-sheet prima facie disclose the alleged offences. Whether the allegations are true or are a product of falsehood and mala fide to implicate the petitioner owing to his shift in political allegiance requires to be assessed during trial.

3. Given this situation, we are of the opinion this is not a fit case to interfere at the present stage.

4. Accordingly, application being CRR 3936 of 2024 is dismissed.

5. Petitioner is at liberty to agitate his grievance at the appropriate stage of the proceeding during trial in accordance with law. (Joymalya Bagchi, J.)
